Product Liability:Two (2) years from when claim accrues.
Personal Injury (Caused by Negligence):Two (2) years from when claim accrues.
Statute of Repose: Although a ten (10) year statute of repose is on the books for product liability actions, the statute of repose was declared unconstitutional in Lankford v. Sullivan, Long & Hagerty, 416 So.2d 996 (Ala. 1982) and has not been applied to a product liability case since.
Accrual Rule:Statute begins to run at the time that personal injury, death or damage to property occurs, or in the exercise of reasonable diligence should have been discovered. For cases involving exposure to toxic substances, a claim accrues only when a manifest injury stemming from the exposure presents itself. (Discovery Rule Based)
