What is a Firepot?
A firepot is a wickless outdoor torch, which uses a jelly-like fuel. A few reports have emerged alleging incidents where a firepot was found to explode, sometimes causing second and third-degree burns to the individual(s) nearby. The manufacturers of the firepot products include BirdBrain, Marshall Garden’s PatioGlo, and Napa Home & Garden.
Due to the recent claims of injuries that have surfaced, it’s possible that all three companies have developed and manufactured a product that may not have properly warned consumers of the potential hazardous conditions that develop when additional fuel is added to the firepot. If BirdBrain, Marshall Garden’s PatioGlo, and/or Napa Home & Garden are found to have not provided adequate testing and warnings, they could potentially be held legally and financially responsible for the injuries causes by their products.
Firepot Gel Fuel Recall
The Consumer Product Safety Commission (CPSC) announced a voluntary recall of Napa Home and Garden˜s NAPAfire and FIREGEL on June 22, 2011, as a result of multiple reported burn injuries. Unfortunately, similar gel fuels manufactured by BirdBrain and Marshall Gardens have caused injuries to consumers as well, but were not included in the firepot gel fuel recall.

A firepot lawsuit seeks to hold the manufacturer of the product responsible for not adequately warning the consumer of potential hazards. The warning label, which alerts the user to the danger of adding more fuel to the firepot while it is lit, is found on a piece of outer packaging that is commonly thrown away.
