Personal Injury (Caused by Negligence):Three (3) years from when claim accrues.
Statute of Repose:There is a rebuttable presumption that the strict liability shall not apply for claims brought more than ten (10) years after the product has been in use.
Accrual Rule:Statute begins to run when the injured party knows, or through reasonable diligence and intelligence should have known, an injury has occurred. This jurisdiction closely resembles the Discovery Rule Based of most other jurisdictions.
